These terms govern purchases made at www.labotavara.eu, the online shop of La Botavara Tienda Marinera S.L. (Tax ID B93296556, Urb. Áncora nº 29, 30380 La Manga del Mar Menor, Murcia, Spain; [email protected]; +34 968 43 05 10). Further company details are in our Legal notice. Anything not covered here is governed by Spanish consumer law (Royal Legislative Decree 1/2007), Law 34/2002 (LSSI) and Law 7/1996 on Retail Trade.
By placing an order you accept these terms as published at that time. Nothing in them limits your statutory rights as a consumer.
1. How to buy
- You can buy with a customer account or as a guest, without registering. You must be of legal age to buy.
- Add products to the cart, enter the delivery address and shipping method, choose how to pay and confirm with the payment button. Before confirming you will see a summary with the total price, shipping costs and taxes, and you can correct any details.
- The contract can be concluded in Spanish or English. You will receive an order confirmation email; we keep a record of the order and, if you registered, you can see it in your account.
- The photos show our products, although colours may vary slightly depending on your screen. Some handmade items (boards, resin pieces, etc.) are one-offs and may differ slightly.
2. Prices
Prices are in euros (€) and include VAT. Shipping costs are shown before you confirm the order and depend on the destination; see Shipping and returns. If a product were shown at an obviously wrong price, we will let you know before shipping and you will be able to cancel the order at no cost.
3. Payment methods
Credit or debit card, Bizum, Apple Pay, Google Pay and PayPal, always through secure payment gateways (Redsys and PayPal). We never store your card details. More information in Secure payment. Payment is taken when you confirm the order.
4. Shipping and delivery times
- Mainland Spain: MRW, delivery in 24-72 working hours. Free shipping on orders over €50.
- Balearic Islands and Portugal: MRW. Rest of Europe: DHL, UPS, DPD or FedEx depending on the destination, in 2-5 working days.
- We do not ship to the Canary Islands, Ceuta or Melilla. For other destinations, write to us for a quote.
- You can also collect your order free of charge at our shop in La Manga.
Delivery times are approximate and start when payment is confirmed. In any case we will deliver within 30 calendar days at most; if that is not possible (for example, because an item has sold out), we will let you know and you can choose to wait or cancel the order, with a refund within 14 days. When you receive the parcel, check that it is in good condition. If it is damaged, tell the courier or, if that is not possible, let us know by email as soon as possible with photos so we can file a claim. Shipments outside the European Union (United Kingdom, Switzerland, Norway, Andorra…) may be subject to import duties or customs fees at destination, which are not included in the price.
5. Right of withdrawal (returns)
You have 15 calendar days from receiving your order (or the last item, if it arrives in several deliveries) to return it without giving any reason. That is one day more than the law requires.
How: tell us before the period ends using the Withdraw from a purchase button (in the site footer, in My account and in each order's details; it also works if you bought as a guest), which instantly emails you an acknowledgement of receipt; or by email to [email protected], or using the form at the end of these terms (optional). Then send the products to our shop (Edificio 2 Mares, local 1, Plaza Bohemia, 30380 La Manga del Mar Menor, Murcia, Spain) within 14 calendar days, or bring them in person.
What we refund: the price of the products and the shipping you paid (standard delivery; if you chose a more expensive option, the difference is not refunded). We refund you within 14 calendar days of being told about your withdrawal, using the same payment method, at no cost to you. We may wait until we have received the products, or proof that you have sent them, before refunding. If you prefer, instead of a refund we can exchange the item for another size, colour or product.
Return costs: the cost of sending the parcel back to us is paid by you, unless the product is faulty or not what you ordered, in which case we pay it. You can use any carrier you like or ask us for an MRW return label; in that case we will tell you its cost beforehand and deduct it from your refund.
Condition of items: you may examine the product as you would in a shop, but if it is used beyond that or returned damaged, we may deduct the loss in value. Please return it with its labels and well packed.
Our personalised flag bracelets can also be returned within the period.
6. Guarantee
All our products have the 3-year legal guarantee from delivery (articles 114 onwards of Spanish consumer law). If a product is faulty or not as described, email [email protected] with your order number and some photos: as the seller, we will sort it out by repairing or replacing it free of charge or, if that is not possible, by reducing the price or refunding you. If the fault appears within the first two years, it is presumed to have existed at delivery. The guarantee does not cover normal wear and tear or damage caused by misuse.
7. Customer service and complaints

We will answer complaints as soon as possible and within one month at the latest. Official complaint forms are available on request. If you are not satisfied, you may contact the consumer services of your region.
8. Applicable law and courts
These terms are governed by Spanish law. If you are a consumer, you may go to the courts of your place of residence.
9. Changes to these terms
We may update these terms. Each order is governed by the terms in force when it was placed.
